The Purina Veterinary Diets® Win it for your Clinic Makeover Sweepstakes (the “Sweepstakes”) is open only to veterinary clinics in the 50 United States and the District of Columbia who use/offer Purina Veterinary Diets® products and currently maintain a professional office space within the 50 United States or the District of Columbia. The Sweepstakes is not open to online merchants or the general public. Void where prohibited or restricted by law.
Sweepstakes begins at 12:00:01 a.m. CT on July 1, 2013 and ends at 11:59:59 p.m. CT on December 31, 2013 (the “Promotion Period”). For the purposes of sweepstakes entry opportunities the Promotion Period is made up of the following (2) two quarterly periods: 1) Q3: July 1, 2013 through September 30, 2013; and 2) Q4: October 1, 2013 through December 31, 2013 (each a “Quarterly Period”).
How it Works
During each Quarterly Period, eligible Veterinary Clinics will receive one entry into the sweepstakes for carrying at least two (2) eligible Purina Veterinary Diets® GI products.
Eligible Purina Veterinary Diets® GI products
- Purina Veterinary Diets® EN Gastroenteric® Canine and Feline Formulas (all dry sizes and wet case of cans, excluding hospital bag)
- Purina Veterinary Diets® HA Hypoallergenic® Canine and Feline Formulas (all dry sizes and wet case of cans)
- Purina Veterinary Diets® DCO Dual Fiber Control® Canine Formula (all dry sizes)
- Purina Veterinary Diets® FortiFlora® Canine and Feline Nutritional Supplements
Eligible veterinary clinics may also receive an additional entry for each of the following activities
- Register for the Purina for Professionals online staffing feeding program at www.purinaforprofessionals.com (see website for details regarding registration; clinics that register during Q3 will also receive and entry for Q4).
- Participate in the Purina Veterinary Diets® Q3 and/or Q4 Trade Promotion. The Q3 promotion is purchase one case of Purina Veterinary Diets® FortiFlora® Feline and receive one six (6) pound bag of Purina Veterinary Diets® EN Gastroenteric® Feline Formula for free. The Q4 promotion is to be determined. (Limit one entry per clinic per quarter.)
- Receive one (1) additional entry for each tier you reach in the Purina®Veterinary Diets ®Clinic Rewards Program for each Quarterly Period:
- Tier One – Increase dollar sales of the eligible Purina Veterinary Diets® products above by at least $400
- Tier Two – Increase dollar sales of the eligible Purina Veterinary Diets® products above by at least $1,000
- Tier Three – Increase dollar sales of the eligible Purina Veterinary Diets® products above by at least $2,000 or more
A clinic’s sales and participation in these promotions and activities will be monitored and verified by Purina for Professionals sales and distributors, whose decisions are final.
By participating, you agree to these Official Sweepstakes Rules, which are final and binding in all respects.
: On or about January 15, 2014, a random drawing to award the prizes will be conducted from all eligible entries by Promotion Fulfillment Center (“Administrator”), whose decisions are final and binding on all matter relating to this Sweepstakes. Limit one (1) prize per clinic.
One (1) Grand Prize: A clinic makeover valued at up to $30,000. Winning clinic will work with Sponsor designated design representative to develop a feasible “re-design” and makeover for existing clinic. All aspects of the clinic makeover will be subject to Sponsors final approval. Sponsor shall select local contractor or other sources as required in the winning clinic’s area to execute makeover. Expenses for the clinic makeover shall not exceed $30,000, including design fees.
Two (2) First Prizes: a trip for up to 2 employees of the winning clinic to the Western Veterinary Conference in Las Vegas, NV beginning 02/17/14 and returning on 02/20/14. Prize includes round trip coach air transportation for up to two from a major airport near the winning clinic to Las Vegas, NV and ground transport from airport to hotel and return to airport on day of departure. Prize also includes standard single hotel room for each employee, 3 nights, tickets to the Western Veterinary Conference and a $300 cash stipend for each employee, issued in the form of a check. The approximate retail value (“ARV”) of each First Prize trip is $3,200. Actual value depends on travel origin and airfare fluctuations. Any difference between the estimated ARV and the actual value will not be awarded. Trip must be booked at least fourteen (14) days prior to departure, through Sponsor’s designated agent. Trip subject to availability and blackout dates. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, unspecified ground transportation, meals, hotel incidentals, airline baggage fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the sole responsibility of winner. Employees must be eighteen (18) years of age or older and of legal age of majority as of the date of departure. Employees must execute liability/publicity releases prior to issuance of travel documents and must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required for travel. Once Employee is selected, he/she may not be substituted, except in Sponsor's sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round-trip air travel at Sponsor’s sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any Prize-related service or accommodation. Additional prize award details and travel information to be provided to each Employee at the time of notification.
Five (5) Second Prizes: a $2,500 Purina authorized distributor credit, prize to be executed through Purina Veterinary Professionals representative, distributor subject to Sponsors full approval. Some limitations may apply with regard to which distributors will accept credit/orders.
Twelve (12) Third Prizes: a Nespresso Pixie espresso maker; Approximate Retail value of each Third Prize: $175.
Eighty (80) Fourth Prizes: a $50 Gift card to a home improvement store. Gift card is subject to standard terms and conditions set by the issuer.
Odds of winning depend on the total number of eligible entries received. Prizes will be awarded to the clinic may not be transferred or assigned. No prize substitution or cash redemption, except in the case of prize unavailability, in which case the Sponsor reserves the right to substitute a prize of equal or greater value. Prizes will be awarded to clinic. Practice manager, Veterinarian or Veterinary technician for the clinic will be contacted regarding prize, as applicable.
Releases and General Conditions
Except where prohibited, clinic representative may be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit"), which must be received by Administrator within seven (7) days of the date notice or attempted notice is sent, in order to claim prize. If a potential winner cannot be contacted, or fails to sign and return the Affidavit within the required time period indicated, potential winner will forfeit the prize. Receiving a prize is contingent upon compliance with these Official Sweepstakes Rules. In the event that a potential winner is disqualified for any reason or prize notification or prize is returned as undeliverable, Sponsor may award the applicable prize to an alternate winner selected at random, from among all remaining eligible entries received during the Promotion Period.
Third and Fourth Prizes will be shipped to winners by mail 4-6 weeks after drawing, to the address provided during registration. If any prize or prize notification is returned as undeliverable, prize may be forfeited and may be awarded to an alternate winner. Acceptance of any prize constitutes permission to use the clinic’s name and, with respect to the First Prize, the name and likeness of each employee who goes on the trip, for publicity purposes without further compensation in any and all media now known or hereinafter without territorial restriction (except where prohibited by law). By accepting a prize, winning clinics agree, to release and hold Nestlé Purina PetCare Company, its subsidiaries, affiliates, directors, employees, agents, successors and/or assigns and their advertising and promotional agencies (“Sweepstakes Parties”), harmless from any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of participation in this Sweepstakes or the acceptance, possession, use or misuse of prize in connection therewith. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event will attorney's fees be recoverable.
Sponsor reserves the right, in its sole discretion to cancel or suspend this Sweepstakes and award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes. Sponsor may prohibit you from participation in the Sweepstakes if Sponsor determines that you have acted in a manner that affects the administration, security, fairness or proper play or conduct of the Sweepstakes in any way, with intent to annoy, threaten or harass any other entrants or the Sponsor. Sponsor reserves the right at its sole discretion, to disqualify any individual, and all of his/her entries, who tampers with the entry process.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Missouri, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in St. Louis, Missouri.
LIMITATIONS OF LIABILITY
No liability or responsibility is assumed by Sponsor or Sweepstakes Parties for any errors in tracking sales or participation in offers. Sponsor and Sweepstakes Parties are not responsible for any typographical errors in the announcement of prizes or these Official Sweepstakes Rules.
